These Terms of Service govern your use of vachansutra.com and any purchase made through it. By using this website or placing an order, you agree to them. Please read them before you buy.
1. Who we are
The website is operated by Vachansutra, 21/31, Mall Ville, Lucknow Road, 1st Floor, Delhi – 110054, India (“Vachansutra”, “we”, “us”). “You” means the person browsing the site or placing an order.
2. Eligibility
You must be at least 18 years old, or be using the site under the supervision of a parent or legal guardian, and be capable of entering a binding contract under the Indian Contract Act, 1872.
3. Your account
You are responsible for the accuracy of the information you give us and for keeping your account credentials secure. Tell us promptly if you believe your account has been used without your permission. We may suspend or close an account used fraudulently or in breach of these terms.
4. Products, materials and descriptions
We describe every piece exactly as what it is. Specifically:
- Our pieces are gold-plated, not solid gold. We do not represent them as gold jewellery or as an investment.
- Where a piece has a solitaire or diamond look, the stone is cubic zirconia unless the product page states otherwise.
- Plating is a finish and wears with use. With normal wear and the care described in our Jewellery Care Guide, the finish typically holds well for around 6 months. That figure is a good-faith expectation based on ordinary use and is not a warranty — actual life depends on how the piece is worn, stored and cared for.
- Each piece is finished by hand, so small variations in colour, weight, length and stone placement are normal and are not defects.
- Product photographs are taken under studio lighting. Colours may appear slightly different on your screen.
5. Pricing and errors
All prices are in Indian Rupees and inclusive of applicable GST unless stated otherwise. We may change prices, run offers, or withdraw offers at any time without notice. If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund you in full — we are not obliged to sell at the incorrect price.
6. Orders and acceptance
Your order is an offer to buy. A contract is formed only when we dispatch the order and send you a dispatch confirmation. We may decline or cancel an order — with a full refund — where stock is unavailable, the price was wrong, the address is not serviceable, payment could not be verified, or we reasonably suspect fraud or misuse (including repeated refusal of Cash on Delivery orders).
7. Payment
We accept the payment methods shown at checkout. Payments are processed by third-party payment gateways; we do not store your card details. Cash on Delivery is available up to ₹5,000 subject to pincode serviceability.
8. Shipping, returns and refunds
Delivery is governed by our Shipping Policy, and returns, exchanges, cancellations and refunds by our Returns & Exchanges and Refund & Cancellation Policy. All of these form part of these terms.
9. Intellectual property
All content on this site — designs, photographs, text, logos and the Vachansutra name — belongs to us or our licensors. You may not copy, reproduce, resell or use it commercially without our written permission.
10. Acceptable use
You agree not to use the site to break any law, infringe anyone's rights, introduce malicious code, scrape or harvest data, resell our products without authorisation, or interfere with the site's operation or security.
11. Reviews and submissions
If you post a review, photograph or comment, you confirm it is your own, and you grant us a non-exclusive, royalty-free licence to use it in our marketing. We may remove content that is unlawful, misleading or abusive.
12. Third-party links
The site may link to third-party websites and services. We do not control them and are not responsible for their content, policies or practices.
13. Disclaimers
The site and its content are provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted or error-free. Nothing here excludes any liability that cannot be excluded under Indian law, including under the Consumer Protection Act, 2019.
14. Limitation of liability
To the extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.
15. Indemnity
You agree to indemnify us against claims, losses and costs arising from your breach of these terms or your misuse of the site.
16. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including natural events, strikes, civil disruption, courier failure, regulatory action or network outages.
17. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Delhi have exclusive jurisdiction over any dispute, subject to your rights to approach a consumer forum under the Consumer Protection Act, 2019.
18. Grievance redressal
Complaints may be sent to our Grievance Officer at vachansutra@gmail.com. We acknowledge complaints within 48 hours and aim to resolve them within one month. Full details are on our Contact page.
19. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you place an order is the one that applies to that order.
